Operating a Waste Facility or Transporting Waste without a Licence or Registration can result in significant penalties.
Management of waste in the ACT falls under the Waste Management and Resource Recovery Act 2016 (the Waste Act).
The aim of the Waste Act is to maximise recycling and reuse and minimise landfilling. It also aims to encourage investment, innovation and best practice in the ACT waste industry.
What is waste?
Generally, any substance that is unwanted, abandoned or thrown away is considered to be waste Exact definitions can be found under the Waste Act.
Am I a waste management business?
If you provide a service relating to the handling of waste, including the transport or storage of waste, which is not generated by your business, it is likely that you will need a Licence or Registration, depending on the nature of what you do.
Businesses in the ACT which provide services such as storing, recycling or recovering waste are considered a Waste Facility and require a Licence to lawfully operate.
Businesses which provide services relating to transporting waste from commercial or residential properties similarly require a Registration.
Businesses who provide other services in addition to waste handling are still required to be Licenced or Registered in the ACT. If you are unsure if you are a waste management business, please contact the Waste Regulation Team for advice.
How much does it cost?
As at July 2019:
Licensed Facilities and Registered Transporters are required to report their waste activities to the ACT Government on a quarterly basis. The ACT government is committed to a better community approach to waste and recycling. By working closely with the waste sector, we are aiming to divert 90% of all waste away from landfill. To do that, we need to know in detail how waste is being managed in the ACT. By understanding the types and volumes of waste generated in the ACT, we can better develop strategies and incentives for best practice in waste management.
Waste Facilities currently report quarterly data via the Waste Activity Management System.
Waste Transporters are scheduled to commence recording data from 1 October 2019. An app for mobile devices is being developed to enable transporters to report their waste data quickly and easily with minimal disruption to their business. It will not be compulsory to use this reporting solution. If your business already collects the required information, you will be able to upload this data on a quarterly basis. Registered Transporters will receive further guidance on reporting requirements prior to the commencement date.
